CONDITIONS FOR PURCHASE OF PRODUCTS
If you are a consumer then none of these Conditions will affect your statutory rights.
Any product ordered from this web site ("Site") will be subject to these Conditions which you accept through placing an order for that product ("Product") through this Site.
1. Supplier
Your contract for the purchase of Product(s) is between you ("you") and Riad Hikaya Limited, Registered Office 37 West Street, Stratford-upon-Avon, Warwickshire, England, CV37 6DN Company No 6632055 ("we, us, our").
2. Price
A) The prices set out include all taxes payable by our customers who are purchasing the Products in England, Wales and Scotland. You may also be subject to import duties and taxes once your order reaches your delivery country. These charges must be borne by you. We have no control over these charges and they vary from country to country. If you are unsure of the relevant import duties and other taxes then you should contact your local custom office for further information.
B) Postage and packing costs are also payable, the charges for which are set out together with the price for the Product(s) on the Site.
3. Delivery
A) Products will be despatched within 7 days of receipt of the order.
B) Please allow 14 days for delivery to any address in England, Wales and Scotland and 28 days outside Europe for delivery via Royal Mail first class post. Please note that deliveries via our Express Delivery Service require a signature.
C) All over the world customs departments randomly select packages, which they will open and check. Although rare they will sometimes open the interior packaging. Unfortunately we cannot accept responsibility for these occurrences as we have no control over Customs officials or for reimbursing you for the cost of the Product and carriage should local authorities choose to confiscate or seize these items. It is your responsibility to ensure that all Product(s) ordered are acceptable and permitted in your country.
D) If, for some reason, it is not possible for us to provide you with some or all of the Product(s) which you have ordered then we will notify you by email and refund you in full for those Products you have paid for and which we cannot supply within 5 days of the date of your order.
4. Payment
A)Your debit/credit card account will be debited with the cost of the Product(s) and any postage and packaging costs when the Product(s) are despatched to you.
B) In circumstances where your entire order is cancelled, we will not debit any money from your debit/credit card account.
C) Any orders placed with us will be converted from pounds sterling into your currency by your credit card company when they process the transaction. Please remember that currency rates change all the time and that we accept no liability for currency fluctuations.
5. Privacy
A) We are committed to protecting the privacy of anyone who uses the Site and to complying with the obligations imposed by the Data Protection Act 1998.
6. Complaints
A) If you wish to make a complaint about our service, please contact us.
7. Changes to the Conditions
A) We are continually seeking to update and improve the Site. Therefore, we may make changes to any part of the Site including these Conditions and you will be bound by the conditions current on the Site on the date when you place an order with us. The prices of the Products will also be subject to change and therefore the price of a Product is only valid at the time when you place an order.
8. Invalidity of Terms and Conditions
A) If any of these Conditions become void or unenforceable for any reason under any applicable law, then such conditions will be deemed omitted from the contract and the validity and/or enforceability of the remaining provisions shall remain in full force and effect.
9. Waiver
A) If either you or we waive any breach of this contract either you or we will still be able to subsequently enforce the Condition that was breached and this shall not be deemed to be a waiver of any subsequent breach of any Condition.
10. Choice of Law and Jurisdiction
A) These terms and conditions are governed by English law and both parties agree to submit to the non-exclusive jurisdiction of the English Courts. |
